Contractual rate, or the statutory late-payment rate if not stated in the contract

How it works

This tool calculates late payment interest on a pro-rata temporis basis: invoice amount × annual interest rate × (number of days late / 365). The number of days late corresponds to the gap between the invoice's due date and the actual payment date (or today's date if it hasn't been settled yet).

Which interest rate should I use?

The applicable rate is in principle the one set out in the contract or the general terms and conditions of sale between the parties. In the absence of a contractual clause, French law provides for the application of the European Central Bank's interest rate increased by 10 points between businesses. This rate changes over time: check the value in effect at the date of the delay before using it.

What is the €40 flat-rate compensation?

In France, in B2B commercial relationships between businesses, a flat-rate recovery compensation of €40 is owed automatically to the creditor in the event of late payment, in addition to late payment interest, without it being necessary to formally claim it beforehand. It generally does not apply to relationships with individual consumers.
